Abstract
Patriarchal bias in public policy in Indonesia constitutes a structural problem that contributes to the weak legal protection of women and children. This study aims to analyze the forms of patriarchal bias in public policy and to examine the absence of the state in providing effective legal protection. The research employs a normative juridical method with statutory and conceptual approaches. The findings indicate that patriarchal bias is manifested in gender-insensitive regulations, weak policy implementation, and institutional fragmentation. The absence of the state is reflected in its failure to provide substantive protection for women and children. Therefore, an interconnection system among institutions is proposed as a strategic solution to establish integrated and equitable legal protection.
