Transformasi Norma Digital: Mengejawantahkan Kecerdasan Buatan dalam Mekanisme Perancangan Hukum di Indonesia

Abstract

Technological disruption has triggered a paradigm shift, transforming traditionally rigid legal systems into agile and responsive frameworks. Digital transformation in legal drafting has evolved from simple digital typing tools to the utilization of Artificial Intelligence (AI) as an optimization engine. In Indonesia, high regulatory complexity—characterized by hyper-regulation and overlapping norms—renders manual and linear conventional methods inadequate. This condition causes the law to lag behind factual reality, leading to legal uncertainty and hindered national economic competitiveness. This research is a normative juridical study employing conceptual, statutory, and comparative approaches. Data were gathered through a comprehensive literature review on the evolution of Legal Tech, AI conceptual frameworks, and global comparisons of AI implementation in legislative processes. Qualitative analysis was used to outline AI's role as a strategic solution for optimizing legal drafting mechanisms in Indonesia. The results conclude that AI acts as a "regulatory architect" through three primary functions: detecting vertical and horizontal normative contradictions, standardizing legal terminology via Natural Language Processing (NLP), and predicting socio-economic impacts. Despite offering high efficiency, AI integration faces ethical challenges, including algorithmic bias and limitations in comprehending local wisdom. Therefore, this study recommends positioning AI as a "co-legislator" by implementing the Human-in-the-Loop (HITL) principle. Synergistic collaboration between machine intelligence and human wisdom is the key to producing smart, responsive, and fair Indonesian legal products in the digital era.
