Abstract

Abstract:  Violations of the principle of neutralization of civil servants have a detrimental impact on their professionalism, as they are dominated by their bias in elections. To prevent civil servants from taking sides in politics, efforts must be made to achieve professionalism. First, what is the legal standing of civil servants based on the principle of neutralization? Second, what sanctions are imposed on civil servants who violate neutrality in order to achieve professionalism? This articles employes a normative judicial research method, it employ a qualitative approach with a descriptove approach. The research instrument is the researcher who sources secondary data.This study examines legal and sociological research to examine how the law is formulated, interpreted, and applied in society. The results of this study indicate that the legal standing of civil servants based on the principle of neutralization is that civil servants, as elements of the state apparatus, implement policies established by the leadership of government agencies and must be free from the influence and intervention of all political groups and parties. The sanction imposed on civil servants who violate the principle of neutrality in order to achieve professionalism is dishonorable dismissal under Article 52 of Law Number 20 of 2023 concerning the State Civil Apparatus. This study recommends that, to achieve professionalism among civil servants, a Civil Servant Supervisory Agency is needed to prevent violations of civil servant neutrality.
